Connection: In class we have been studying about court cases as well as there relevance in today's society. The Roe v. Wade case is a perfect example of a court case that is relevant.
Summary:
President-elect Donald Trump has been in the news a lot recently because of his stance on abortion and the court case Roe v. Wade. Donald Trump has said that he plans on placing an anti-abortion justice in the Supreme Court. These statements have worried many about the future of women's rights in the United States. Changes to laws regarding abortion have already been made. In Texas it is now required to burry the fetus remains from the abortion and in Ohio it is now illegal to have an abortion once a fetal heartbeat can be detected. These changes to the law of abortion mark a shift in the view of the public and can lead to a shift in women's rights. Many people have already planned a march in protest of Trump's views the day after he takes office.

I think the article made a very interesting point in regards to the fact that the primary danger to women's rights lies in the individual state legislature process. This can be seen from the various state legislations passed such as in Texas which imposes undue burdens on women attempting to get abortions. However, the fact that the issues with women's reproductive rights stems from state legislation might make it easier for women to take a stance in their individual states. They can go to the polls or write to their state leaders to express their opinions.
ReplyDeleteTrump has gone back and forth on his stance on abortion. As Trump enters the executive branch, I believe he will align with the Republican party and nominate a conservative judge. By doing so, abortions may no longer be protected by the federal government. Conservative states will be affected most as they will be able to put more regulations on or even ban abortion. In California, I don't believe such legislation will have a major impact.
ReplyDeleteI agree with Easton that Trump will likely nominate a conservative judge in order to keep with the Republican stance on abortion. Since conservatives are more keen to states rights, abortion regulations will vary from state to state, making it much harder for women to have the procedures that they rightfully deserve. As Easton said, California will most likely keep a pro-choice stance on abortion, but it will definitely affect the women who are unable to get the money to leave their conservative state, which will lead to more children who could potentially be neglected due to the fact that their parent(s) cannot afford to take care of them.
DeleteAs disappointing this all is, it’s not surprising after the result of the election. Now that the Republicans control both the White House and Congress, if Trump is able to nominate a right wing justice, it will be very easy to pass legislation on issues that he stands for. Women should be worried about their rights, however should not lose hope. The choice on whether or not to have an abortion not only affects women, but can impact men as well, which is why if any potential federal changes were to happen, wouldn’t happen without a fight. As long as people continue to make their voices heard, eventually it will be difficult to try to go against the wish of the people.
ReplyDeleteIf Roe v. Wade is overturned, there are only a few things that can be done to save abortion rights. Illegal abortions have been performed since before abortion was legal, so that will always be an option. However, it's possible that if abortions are legal under state law, Federal authorities might not have the time or resources to enforce laws that say otherwise (much like with the legalization of marijuana in Colorado.) The fully legal route would be to overturn the decision that itself overturns Roe v. Wade, but that could take several years.
ReplyDeletePeople should absolutely be worried for women's rights during this presidency. Trump hhas already made it clear that his opinion of women is not particularly high, and with Mike Pence as his VP, there is a lot to be worried about. However, I think the article was correct in saying that a lot of the decisions that effect women will be made on the local and state level. While Trump may be able to pass the overarching law, it will be up to the states to decide how to implement and interpret these laws. Therefore, there is a lot of leeway in terms of strictly these laws may be applied, and considering that there will most likely be a lot of Democratic push back at the local level, there may be some victories for women to come.
ReplyDeleteI believe that the biggest change that Trump can make regarding Women's Right is the appointment of an Anti-Abortion justice because of Scalia's absence and the possible retirement of other justices. This will increase tensions regarding abortion, and laws may be passed that severely affect women and the decisions about their own bodies. It still would be difficult to overturn Roe v. Wade because it was decided in 1973, a less progressive era, and a 7 to 2 decision. But it is entirely possible that the Supreme Court, with the anti-abortion justices that Trump may appoint, can make some pretty major decisions that will affect the women in our society.

The recent questions over anti-abortion laws due to Scalia's absence and the possible retirement of other justices will definitely increase tensions regarding abortion. The power that Trump has within government right now is scary especially because of the fact that he can appoint a new justice and with that justice, can mae a lot more conservative legislation possible.
DeleteWith Trump already releasing statements that he will enact legislation against abortion and strike down such things like Planned Parenthood, women should be concerned about the future of their rights. Another statement that Trump makes is his promise to appoint an anti-abortion judge that is inline with Trump's intention to strip away women's rights. In retaliation of these changes, Gloria Steinem has been praising women's energy in organizing signs of protest. For instance, a planned women's march on Washington, the day after Trump takes office.
ReplyDeleteTrump has repeatedly flipped his positions on abortion. While it is difficult to predict anything that Trump does, it is more than likely that he will align with the Republican party's anti-abortion position. It is also very likely that he will appoint conservative justices to the supreme court. As a result, states will receive more room to implement their own policies regarding abortion. This will likely have a greater effect on conservative states rather than liberal states.
ReplyDeleteI agree, and think that Trump will likely side with the conservatives on this issue, but ultimately I think he will leave it up to the states and not try to completely repeal it.
DeleteOne of the most significant things Trump can do during his presidency is the appointment of Supreme Court justices. If Trump decides to follow through on his campaign promise and appoint an Ultra-conservative to the Supreme Court then women's rights could be significantly impacted, especially when it comes to abortion. If the court decides to overturn Roe v. Wade, it will be very difficult for women to able to legally get an abortion.
